Topic:  OSHA’s New Retaliation Rule:  Drug Testing Not Safe for Employers

In May 2016, OSHA published what appeared to be a non-controversial rule requiring employers to have a reasonable procedure for employees to report workplace injuries and prohibiting employers from retaliating against employees who report injuries.  No big deal.  Several months later, OSHA offered its highly-controversial interpretation of that same rule – suggesting that blanket post-accident drug testing would be a per se violation of the anti-retaliation provision as such a policy might discourage employees from reporting injuries.  A very big deal for safety conscious employers.  We’ll review the legal status of OSHA’s guidance which is facing court challenges, as well as the types of drug –testing which may still be permissible under the guidance.
